Gee some people have no idea what damage they are doing to her image! There are far too many unlicensed things out there!!!

Handcrafted items are seldom legal. If someone draws Betty on their pencil case they are unlikely to ask for permission from King Features - nor do they need to unless they sell the item later.

However, I suspect most of these items aren't from individual sellers and most of them aren't "handcrafted." This makes them doubly illegal because they're unlicensed and they are being sold under false pretences.

I'm still learning about what is legal and what isn't but I'm fairly certain that anything "handcrafted" isn't legal.

We know what we mean, but be careful with the term "legal."

Copyright violations are generally pursued through the civil courts. A seller can be in breach of copyright and can be ordered to pay damages and withdraw the item for sale. He or she is not, however, breaking the criminal law.

If the seller refuses to withdraw the item or pay the damages, then he or she is guilty of contempt of court. That is illegal.

If we accuse someone publicly of doing something illegal - as opposed to breaching copyright - then we are commiting slander. That is illegal.

At least that's my understanding. If anyone here has legal training I'd welcome their comments.
